Daniel Klingenberger, one of the firm’s founding partners, has more than 17 years of experience representing companies in all forms of employment litigation, including wrongful termination, sex harassment, overtime compensation, wage and hour violations, unfair competition/trade secret issues and many forms of discrimination.

Mr. Klingenberger has litigated hundreds of cases in state and federal court and has tried cases to a verdict, both jury and non-jury. These cases have involved single and multiple plaintiff lawsuits, as well as class actions and other complex litigation.

Formerly a shareholder (partner) with Littler Mendelson’s offices in Bakersfield and Fresno, Mr. Klingenberger has devoted his entire legal career to labor and employment law.

Mr. Klingenberger works with employers on union/management issues, including union organizing, picketing and work stoppages.  He represents employers in collective bargaining negotiations and labor arbitrations involving employee discipline and contractual disputes. Mr. Klingenberger has represented clients in both National Labor Relations Board and Agricultural Labor Relations Board proceedings.

Mr. Klingenberger regularly practices in front of the California Labor Commissioner, the California Department of Fair Employment and Housing, U.S. Department of Labor and federal and state OSHA.

Mr. Klingenberger counsels employers on the development of employee handbooks and other company policies. His range of experience allows him to advise employers on day-to-day employee and business planning matters.

PROFESSIONAL ACTIVITIES

Mr. Klingenberger is a member of the State Bar of California and its labor and employment and Litigation Sections. Within the American Bar Association, he also is a member of its Sections on Litigation as well as Labor and Employment Law.

A member of both the Bar Association of Kern County and the Bar Association of Fresno County, Mr. Klingenberger is admitted to practice before all trial and appellate courts of the State of California, all United States District Courts in California and the Ninth Circuit Court of Appeals.  

Mr. Klingenberger has been a long-standing member, and has twice served as chairman of the Labor and Employment Law Committee of the Greater Bakersfield Chamber of Commerce, where he has presented monthly updates on labor and employment law. He also is a member of the Society of Human Resource Management.  

A frequent speaker before business and professional groups, Mr. Klingenberger is skilled at training employees in the workplace.

COMMUNITY INVOLVEMENT

Mr. Klingenberger is a member of the board of directors for the Greater Bakersfield Chamber of Commerce.  He has also served for many years on the board of directors for the United Way of Kern County and is presently chairman of the board.

EDUCATION

Mr. Klingenberger received his undergraduate degree from Creighton University in Omaha, Nebraska where he was president of the Honor Society. He received his law degree from McGeorge School of Law in Sacramento, Ca.

Prior to attending law school, Mr. Klingenberger worked for many years in various management positions with a large national trucking company.

In addition to his litigation practice, Mr. Klingenberger enjoys counseling employers on the development of employee handbooks and other company policies.
